POOL CLOSING / WINTERIZATION SERVICE DISCLOSURE
PURPOSE OF SERVICE
Crystal Water Pool Services provides seasonal pool closing and winterization services designed to prepare swimming pools and accessible pool equipment for periods of non-use during colder weather.
Pool closing service is intended to reduce the risk of freeze-related damage to accessible plumbing and equipment. Winterization reduces risk but cannot eliminate all risks associated with freezing temperatures, weather conditions, equipment failures, water intrusion, structural defects, power outages, or other conditions beyond our control.
Pool closing service is a non-itemized seasonal service package. Services are performed as a complete closing package, and individual tasks are not sold or billed separately.
SCOPE OF SERVICE
Pool closing services may include, when applicable:
• Draining water from accessible pumps, filters, heaters, chlorinators, and related equipment
• Blowing out accessible plumbing lines
• Installing winterizing plugs where applicable
• Blowing and air-locking main drain lines when possible
• Adding pool antifreeze when required
• Installing Gizzmo freeze protection devices in skimmers when applicable
• Removing ladders, handrails, and removable accessories
• Shutting off accessible gas supplies to pool heaters
• Installing customer-supplied winter covers
• Securing covers using available hardware and anchoring systems
• Basic visual inspection of accessible equipment
Services performed may vary based upon pool type, equipment configuration, accessibility, weather conditions, site conditions, and the condition of existing equipment.
FINAL CLEANING NOT INCLUDED
Pool closing service does not include final pool cleaning unless specifically requested, quoted, and scheduled in advance.
Customers are strongly encouraged to have pools cleaned prior to closing. Excessive debris, leaves, algae, staining, contaminated water, or poor water quality left in the pool at closing may increase the likelihood of staining, algae growth, water quality deterioration, unpleasant odors, or difficult spring openings.
Any requested final cleaning service will be quoted separately and is not included in standard closing pricing.
POOL WATER CONDITION DISCLAIMER
Pool closing service does not include water balancing, algae remediation, Green-to-Clean restoration, pool restoration, stain removal, or correction of existing water quality issues unless specifically quoted as additional services.
Pools that are green, cloudy, discolored, foul-smelling, contaminated, algae-infested, or otherwise not in normal swimming condition at the time of closing may experience additional deterioration during the off-season.
Crystal Water Pool Services makes no guarantee regarding water clarity, sanitation, algae prevention, staining prevention, or water quality at the time of spring opening.
CUSTOMER-SUPPLIED COVER REQUIREMENTS
Customers are responsible for providing a pool cover that is properly sized, serviceable, and suitable for the pool.
Customers are also responsible for supplying all required cover hardware, including but not limited to:
• Springs
• Straps
• Anchors
• Water bags
• Sand bags
• Cover clips
• Fasteners
• Other cover securing components
Crystal Water Pool Services is not responsible for damage resulting from worn, deteriorated, improperly sized, defective, missing, damaged, or insufficient cover materials or hardware.
POOL COVER PERFORMANCE DISCLAIMER
Crystal Water Pool Services installs customer-supplied covers using available hardware and accepted industry practices. However, Crystal Water Pool Services does not guarantee cover performance throughout the off-season.
Pool covers may be affected by weather conditions, snow loads, ice accumulation, high winds, water accumulation, deteriorated hardware, animal activity, vandalism, falling debris, shifting ground conditions, or other circumstances beyond our control.
The customer remains responsible for monitoring cover condition throughout the off-season and promptly addressing any issues that may arise.
MISSING OR DAMAGED COMPONENTS
Replacement of damaged, missing, deteriorated, seized, broken, stripped, or non-functional plugs, fittings, valves, O-rings, anchors, springs, straps, water bags, hardware, or equipment components is not included in standard closing pricing.
Required replacement materials will be billed separately when available.
WEATHER, SAFETY, AND SCHEDULING CONTINGENCIES
Pool closing services are highly dependent upon weather conditions, safe working conditions, and access to the pool and equipment.
Crystal Water Pool Services reserves the right to postpone, reschedule, delay, shorten, or suspend service due to:
• Lightning or thunderstorms
• Heavy rainfall
• High winds
• Flooding
• Snow or ice
• Freezing conditions
• Unsafe pool deck conditions
• Limited access to equipment
• Restricted access to the property
• Other unsafe conditions beyond our reasonable control
When weather-related delays occur, service will be rescheduled at the earliest reasonable opportunity based upon technician availability, weather conditions, and route scheduling.
Customers acknowledge that severe weather, early freezes, snow accumulation, flooding, high winds, and other environmental conditions may impact scheduling, winterization effectiveness, cover performance, and overall pool conditions.
WINTER CONDITIONS AND POST-CLOSING RESPONSIBILITIES
Once a pool has been winterized, the customer remains responsible for monitoring the property and pool throughout the off-season.
Customers should periodically inspect:
• Pool cover condition
• Water levels
• Cover anchors and hardware
• Water bags and securing systems
• Storm damage
• Fallen trees or debris
• Evidence of vandalism or tampering
Crystal Water Pool Services is not responsible for damage occurring after service completion due to weather events, vandalism, animals, shifting ground conditions, falling trees, flooding, cover failures, improper water levels, or unauthorized tampering.
WINTER WATER LEVEL RESPONSIBILITY
Following completion of winterization service, the customer is responsible for periodically monitoring pool water levels throughout the off-season.
Water levels may change due to evaporation, precipitation, leaks, cover pumping, groundwater conditions, freeze-thaw cycles, equipment issues, or other environmental factors.
Crystal Water Pool Services is not responsible for damage resulting from improper water levels, including but not limited to liner movement, liner shrinkage, floating liners, cover damage, structural damage, pool wall movement, or equipment damage occurring after winterization service has been completed.
FREEZE DAMAGE DISCLAIMER
While winterization procedures are designed to reduce the risk of freeze damage, Crystal Water Pool Services cannot guarantee against freeze-related damage.
Freeze damage may result from:
• Pre-existing plumbing defects
• Underground pipe damage
• Improper pool construction
• Equipment failure
• Water intrusion
• Power outages
• Extreme weather events
• Shifting ground conditions
• Undiscovered leaks
• Customer actions or omissions
• Unauthorized tampering after service completion
Crystal Water Pool Services shall not be responsible for freeze damage resulting from conditions beyond the scope of the closing service.
SPRING OPENING, WATER CONDITION, AND UNKNOWN CONDITIONS DISCLAIMER
Pool closing and winterization services are performed based upon the visible and accessible conditions present at the time of service. Crystal Water Pool Services cannot inspect, evaluate, diagnose, or guarantee the condition of underground plumbing, concealed equipment components, internal equipment parts, structural elements, or other conditions that are not readily visible during the closing process.
The effectiveness of winterization procedures may be affected by pre-existing defects, hidden damage, equipment deterioration, underground leaks, plumbing failures, structural issues, improper installation, previous repairs, manufacturer defects, or other conditions that are unknown or undiscoverable at the time of service.
Crystal Water Pool Services makes no guarantee regarding the condition of pool equipment, plumbing systems, automation systems, heaters, filters, pumps, sanitization systems, electrical components, water quality, or overall pool condition at the time the pool is reopened.
Customers acknowledge that the condition of the pool at spring opening may be affected by numerous factors beyond the scope of the closing service, including but not limited to:
• Water chemistry at the time of closing
• The condition and cleanliness of the pool when closed
• Whether final cleaning services were performed
• Whether winterizing chemicals were applied
• Weather conditions during the off-season
• Cover condition and effectiveness
• Water loss or water intrusion
• Equipment failures
• Freeze-thaw cycles
• Power outages
• Wildlife activity
• Storm damage
• Vandalism or unauthorized tampering
• Hidden defects or pre-existing damage
Because Crystal Water Pool Services may not have performed the final cleaning, water balancing, chemical treatment, algae remediation, or other pre-closing preparation services, no guarantee is made regarding water clarity, sanitation levels, algae growth, staining, debris accumulation, odors, contamination, or overall water quality when the pool is reopened.
Any conditions discovered at spring opening shall be evaluated based upon the circumstances present at that time and shall not be presumed to have resulted from the winterization service itself.
PRE-EXISTING EQUIPMENT CONDITION
Pool closing service is not a comprehensive equipment inspection.
Crystal Water Pool Services does not disassemble, internally inspect, pressure test, or evaluate the internal condition of pumps, filters, heaters, automation systems, sanitization equipment, valves, underground plumbing, electrical systems, or other pool components as part of standard winterization service.
Existing wear, deterioration, corrosion, cracking, leaks, blockages, freeze damage, manufacturing defects, prior repairs, improper installation, or other hidden defects may not be visible during the closing process and may become apparent only when the pool is reopened and equipment is returned to operation.
The discovery of equipment failures, plumbing leaks, structural issues, or other defects at spring opening shall not be presumed to indicate that such conditions existed at the time of closing or resulted from the winterization service itself.
EXCLUSIONS AND LIMITATIONS
Pool closing service does not include:
• Pool repairs
• Equipment diagnostics
• Leak detection
• Pressure testing
• Plumbing inspections
• Structural inspections
• Pool cover cleaning
• Pool cover repairs
• Pool cover replacement
• Green-to-Clean services
• Algae remediation
• Pool restoration
• Snow or ice removal
• Winter service calls
• Emergency weather-related visits
• Spring opening services
Such services, if available, will be quoted separately.
CUSTOMER AVAILABILITY AND SERVICE AUTHORIZATION
The customer is not required to be present during service unless otherwise requested.
By scheduling service and providing access to the property, the customer authorizes Crystal Water Pool Services to perform the winterization procedures deemed appropriate based upon the pool configuration, equipment layout, site conditions, and circumstances observed at the time of service.
SERVICE DOCUMENTATION
Crystal Water Pool Services reserves the right to photograph pool conditions, equipment, plumbing components, water levels, pool covers, and related areas before, during, and after service for documentation, quality control, training, insurance, warranty administration, and dispute resolution purposes.
CUSTOMER ACKNOWLEDGMENT
By scheduling pool closing or winterization service, the customer acknowledges and agrees that:
• Pool closing service is a seasonal winterization service and not a guarantee against freeze damage.
• Pool closing service is intended to reduce the risk of winter-related damage but cannot eliminate all risks associated with weather, equipment condition, hidden defects, water conditions, vandalism, tampering, or circumstances beyond Crystal Water Pool Services' reasonable control.
• Final cleaning is not included unless separately quoted and scheduled.
• Water quality at spring opening cannot be guaranteed.
• Pool covers and cover hardware must be supplied in serviceable condition by the customer.
• Additional materials may be required and billed separately.
• Weather conditions may affect scheduling and service timing.
• The customer remains responsible for monitoring the pool, water level, and pool cover throughout the off-season.
• Crystal Water Pool Services is not responsible for damage resulting from weather events, vandalism, tampering, equipment failures, pre-existing defects, hidden defects, or conditions beyond our reasonable control.
By requesting, scheduling, approving, or permitting pool closing service to be performed, the customer acknowledges that they have read, understood, and agree to the terms, limitations, responsibilities, exclusions, and conditions outlined in this disclosure.
