CRYSTAL WATER POOL SERVICES

REPAIR, INSTALLATION & SPECIALTY SERVICE AGREEMENT
PURPOSE OF SERVICE
This Agreement applies to repair services, diagnostics, troubleshooting, leak detection, equipment replacement, equipment installation, liner replacement, plumbing repairs, automation work, specialty projects, and other non-routine pool services performed by Crystal Water Pool Services.
Many pool systems contain hidden, underground, inaccessible, deteriorated, improperly installed, modified, or previously repaired components. As a result, the full scope of a problem or project may not be identifiable until work begins or additional components are exposed.
By authorizing service, the customer acknowledges that unknown conditions may affect project scope, labor requirements, material requirements, pricing, scheduling, and completion timelines.
PAYMENT TERMS
• A deposit may be required prior to scheduling, ordering materials, or beginning work.
• Large projects typically require a 50% deposit unless otherwise stated in writing.
• Special-order materials, custom products, liners, covers, and certain equipment may require payment in full prior to ordering.
• The remaining balance is due immediately upon completion of service unless otherwise agreed in writing.
• Customer agrees to comply with the current Crystal Water Pool Services Payment Policy.
DEPOSITS AND MATERIALS
• Deposits secure scheduling, labor allocation, project preparation, and material purchases.
• Once materials have been ordered, purchased, fabricated, delivered, or otherwise committed to a project, deposits may become partially or fully non-refundable.
• Material pricing and availability are subject to supplier inventory, manufacturer pricing, freight costs, tariffs, and market conditions beyond Crystal Water Pool Services' control.
QUOTE VALIDITY
Unless otherwise stated in writing, all quotes and estimates are valid for thirty (30) days from the date issued.
Pricing, material availability, and scheduling may be adjusted after the expiration of the quote period.
DIAGNOSTIC SERVICES
Diagnostic services are investigative in nature and are intended to identify, isolate, evaluate, or narrow down the cause of a problem.
The customer acknowledges that diagnostic services are billable regardless of whether:
• The exact cause of the problem is identified
• The problem can be repaired
• The repair is approved
• Additional issues are discovered
• The customer elects not to proceed with repairs
Diagnostic fees compensate Crystal Water Pool Services for professional expertise, testing, troubleshooting, travel, equipment usage, and evaluation time.
No guarantee is made that a diagnostic visit will result in a complete diagnosis or permanent solution.
REPAIR SERVICES
Repairs are performed based upon conditions visible and known at the time work is authorized.
Additional defects, deterioration, improper prior repairs, code issues, hidden damage, plumbing failures, electrical issues, structural problems, equipment failures, or other unforeseen conditions may be discovered during the course of work.
Such discoveries may require additional labor, materials, service visits, recommendations, or revised pricing.
Repairs are limited to the specific components authorized for repair and do not constitute a comprehensive inspection of the entire pool system.
USED EQUIPMENT AND EXISTING COMPONENTS
Crystal Water Pool Services cannot guarantee the performance, reliability, compatibility, efficiency, lifespan, or future operation of:
• Existing equipment
• Used equipment
• Customer-supplied equipment
• Previously repaired equipment
• Existing plumbing systems
• Existing automation systems
• Existing electrical systems
Repairing or replacing one component does not guarantee the condition or future performance of any other component within the pool system.
The failure of related components before, during, or after repairs shall not be presumed to indicate improper workmanship.
NEW EQUIPMENT INSTALLATIONS
New equipment installations may be covered by applicable manufacturer warranties and any workmanship warranty provided in writing by Crystal Water Pool Services.
No warranty is provided beyond those expressly stated in writing.
Manufacturer defects, warranty limitations, product recalls, shipping damage, and equipment failures remain subject to manufacturer terms and conditions.
LEAK DETECTION SERVICES
Leak detection is an investigative process intended to identify potential sources of water loss.
Not all leaks can be identified during a single visit.
Leaks may be intermittent, concealed, underground, structural, weather-related, pressure-dependent, inaccessible, or otherwise difficult to isolate.
Leak detection services are billable regardless of whether the exact source of water loss is identified.
Additional testing, pressure testing, dye testing, excavation, equipment disassembly, or follow-up visits may be necessary.
LINER REPLACEMENT PROJECTS
Liner replacement projects involve significant unknown conditions that cannot be fully evaluated until the existing liner is removed.
Crystal Water Pool Services cannot determine the condition of the pool floor, vermiculite base, sand base, foam products, wall panels, coping systems, track systems, plumbing penetrations, fittings, structural components, groundwater conditions, or other concealed areas until liner removal has occurred.
Upon removal of an existing liner, additional issues may be discovered, including but not limited to:
• Groundwater intrusion
• Washouts
• Floor deterioration
• Vermiculite damage
• Structural damage
• Rust
• Wall damage
• Settlement
• Plumbing issues
• Fitting damage
• Hidden leaks
• Improper prior repairs
Any such conditions may require additional labor, materials, appointments, equipment, excavation, repairs, or revised pricing.
The customer acknowledges that liner replacement pricing is based upon visible conditions and may be adjusted if concealed conditions are discovered.
GROUNDWATER AND SITE CONDITIONS
Crystal Water Pool Services shall not be responsible for delays, complications, liner floating, structural movement, washouts, excavation issues, groundwater intrusion, hydrostatic pressure, soil movement, drainage conditions, or other site-related conditions beyond our reasonable control.
WEATHER, SAFETY, AND SCHEDULING CONTINGENCIES
Project schedules are estimates only and are subject to change.
Scheduling may be affected by:
• Weather conditions
• Heavy rainfall
• Lightning
• High winds
• Flooding
• Groundwater conditions
• Material availability
• Supplier delays
• Utility interruptions
• Unsafe working conditions
• Equipment availability
• Site accessibility
• Seasonal demand
Crystal Water Pool Services reserves the right to postpone, delay, suspend, shorten, or reschedule work when conditions are unsafe, impractical, or outside our reasonable control.
CUSTOMER RESPONSIBILITIES
The customer agrees to:
• Provide reasonable access to the property, pool, equipment, and work areas
• Maintain electrical, gas, and water service when required
• Remove vehicles, furniture, toys, pets, and personal property from work areas
• Promptly communicate concerns or requested changes
• Obtain any required homeowner association approvals
Delays caused by customer actions, inaccessibility, utility interruptions, site conditions, or failure to provide access may result in additional charges or schedule adjustments.
SERVICE DOCUMENTATION
Crystal Water Pool Services reserves the right to photograph pool conditions, equipment, plumbing, liners, structural components, work areas, and project progress before, during, and after service for documentation, quality control, insurance, warranty administration, training, and dispute resolution purposes.
LIMITATION OF LIABILITY
Crystal Water Pool Services shall not be responsible for losses, delays, damages, water quality issues, equipment failures, hidden defects, pre-existing conditions, manufacturer defects, supplier delays, weather-related impacts, groundwater conditions, utility interruptions, vandalism, tampering, or other circumstances beyond our reasonable control.
CUSTOMER ACKNOWLEDGMENT
By approving a quote, paying a deposit, scheduling service, authorizing work, or permitting service to be performed, the customer acknowledges and agrees that:
• Diagnostic services are billable regardless of outcome.
• Leak detection services are billable regardless of outcome.
• Repairs do not guarantee future performance of existing equipment.
• Existing, used, customer-supplied, or previously repaired equipment cannot be warranted.
• Hidden defects may be discovered during service.
• Additional labor, materials, appointments, or costs may become necessary.
• Liner replacement projects may reveal concealed conditions not visible before liner removal.
• Project timelines may be affected by weather, groundwater, material availability, and other conditions beyond Crystal Water Pool Services' reasonable control.
• Crystal Water Pool Services cannot guarantee conditions that are concealed, inaccessible, unknown, or undiscoverable at the time service is authorized.
• Customer agrees to the current Crystal Water Pool Services Payment Policy.
By requesting, scheduling, approving, authorizing, or permitting service to be performed, the customer acknowledges that they have read, understood, and agree to the terms, conditions, responsibilities, exclusions, limitations, and expectations outlined in this Agreement.
